1. Acceptance of the Terms
By accessing or using this website and web application (the "Application"), you agree to be bound by these Terms & Conditions of Use (the "Terms"). If you do not agree with these Terms, you must not access or use the Application.
By registering for yourself or another player, playing in leagues, or using the Application, you acknowledge that there is good and valuable consideration for this Agreement, including the ability to participate in tennis leagues and use the Application's services.
You represent and warrant that:
- You are at least 18 years old or the age of majority in your jurisdiction
- You have the legal capacity to enter into a binding agreement
- You will comply with all applicable laws and regulations when using the Application
The Operators reserve the right to update these Terms at any time without prior notice. Your continued use of the Application following the posting of changes means you accept those changes.
2. League Participation
The Application facilitates participation in recreational tennis leagues. All scheduling, match play, and interactions among users occur independently of the Application. The Operators do not organize, supervise, oversee, or participate in any matches or in-person meetings between users.
You are solely responsible for:
- Your conduct, scheduling, communications, and results
- Exercising reasonable judgment when arranging matches
- Complying with applicable laws and facility rules
- Your own safety and the safety of others during matches
The Application is merely a platform for connecting players. The Operators have no involvement in, control over, or responsibility for any activities that occur outside the Application.
3. Physical Safety and In-Person Interactions
READ THIS SECTION CAREFULLY. IT SIGNIFICANTLY AFFECTS YOUR LEGAL RIGHTS.
3.1 No Verification or Screening
THE OPERATORS DO NOT:
- Conduct criminal background checks on users
- Verify the identity, age, or eligibility of users
- Screen users for safety, criminal history, or fitness to participate
- Monitor user conduct outside the Application
- Verify the accuracy of profile information, photos, or user representations
- Investigate or certify the safety of tennis facilities or courts
You acknowledge and agree that you may encounter users with:
- Criminal backgrounds or histories of violence
- Dishonest or fraudulent intentions
- Mental health issues or dangerous behavior patterns
- False identities or misrepresented information
3.2 Assumption of All Risks
YOU EXPRESSLY ASSUME ALL RISKS associated with meeting, interacting with, or playing tennis with other users in person, including but not limited to risks of:
- Physical Harm: Bodily injury, assault, battery, violence, sexual assault, wrongful death
- Criminal Activity: Theft, robbery, fraud, harassment, stalking, kidnapping, or any other criminal conduct
- Property Damage: Loss, theft, or damage to personal property including vehicles, equipment, and belongings
- Emotional Harm: Psychological trauma, emotional distress, anxiety, or mental suffering
- Health Risks: Communicable diseases, COVID-19 or other illnesses, medical emergencies
- Sports Injuries: Sprains, fractures, concussions, heat exhaustion, dehydration, or any injury inherent to playing tennis, including injuries to bones, joints, ligaments, muscles, tendons, and the neurological, vascular, and/or musculoskeletal systems
- Facility Risks: Unsafe court conditions, inadequate lighting, slipping and falling, striking obstructions, hazardous environments, equipment failure
- Weather Risks: Temperature exposure, extreme heat or cold, adverse weather conditions
- Miscommunication: Misunderstandings, disputes, or conflicts with other users
YOU FURTHER REPRESENT AND ACKNOWLEDGE THAT:
- You understand that tennis entails known and unanticipated risks that could result in physical or emotional injury, paralysis, death, or damage to yourself, your property, or third parties
- You understand that such risks simply cannot be eliminated without jeopardizing the essential qualities of the activity
- You have consulted with physicians and other medical advisors as appropriate
- You have taken into account their advice and have made your own independent determination to participate
- You are physically fit and capable of safely participating in tennis activities
- You are aware of your own physical limitations and will not exceed them
3.3 No Responsibility for User Conduct or Facilities
The Operators exercise no control over and assume absolutely no responsibility for:
- The conduct, actions, intentions, or omissions of any user
- The safety, suitability, or legality of any meeting location
- The inspection, investigation, safety certification, or maintenance of tennis facilities or courts
- The condition, suitability, or safety of any venue or playing surface
- Whether facilities comply with safety standards, regulations, or codes
- The truthfulness or accuracy of information provided by users
- Disputes, conflicts, or incidents between users
- Any illegal, harmful, or negligent acts by users
YOU UNDERSTAND AND AGREE that the Operators facilitate the scheduling of tennis matches only and do not investigate facilities, courts, or venues. You are solely responsible for evaluating the conditions of play and each facility to ensure it meets your personal standard of safety and playability. By choosing to play at a facility, you agree to do so at your own risk.
3.4 Your Responsibilities
YOU ARE SOLELY RESPONSIBLE FOR:
- Conducting your own background checks or verification of users you choose to meet
- Selecting safe, appropriate, and legal meeting locations
- Inspecting facilities and courts for safety before playing
- Taking all necessary precautions for your personal safety and security
- Informing others of your whereabouts and match schedule
- Trusting your instincts and removing yourself from any uncomfortable situation
- Complying with all applicable laws, including local ordinances and facility rules
- Obtaining adequate personal insurance coverage for injuries or losses
- Reporting any criminal activity or threats to local law enforcement immediately
YOU REPRESENT AND AGREE THAT:
- You have adequate insurance (health, liability, disability, etc.) to cover any injury or damage you may cause or suffer while participating in the League
- If you do not have adequate insurance, you expressly agree to bear all costs of such injury, damage, or loss yourself
- The Operators have no obligation to provide insurance coverage for participants
- You will not hold the Operators responsible for any medical expenses, lost wages, or other costs arising from your participation
3.5 Safety Recommendations (Not Guarantees)
While the Operators make no guarantees, provide no warranties, and assume no duty of care or protection, we strongly recommend the following safety practices:
Before Meeting:
- Communicate with your match opponent through the Application first
- Verify the identity of the person you're meeting (ask for verification if needed)
- Research and select only public, well-lit, reputable tennis facilities
- Inform a trusted friend or family member of your match details (location, time, opponent name)
- Arrange to check in with someone before and after the match
- Inspect the facility and court conditions before playing
During the Match:
- Meet only in public facilities during normal operating hours
- Trust your instincts—if something feels wrong, leave immediately
- Keep personal belongings secure and within sight
- Avoid sharing excessive personal information (home address, financial details, etc.)
- Do not accept rides or invitations to private locations from someone you just met
- Keep your phone charged and accessible for emergencies
- Stay hydrated and take breaks as needed
- Do not play while under the influence of alcohol or illegal drugs
After the Match:
- Report any suspicious, threatening, or inappropriate behavior immediately
- Contact law enforcement if you experienced or witnessed criminal activity
- Use the Application's reporting features to flag problematic users
IMPORTANT: These recommendations are suggestions only. Following them does not guarantee your safety, and the Operators assume no liability even if you follow all recommendations.
3.6 Voluntary Participation
YOU ACKNOWLEDGE THAT:
- You have voluntarily registered to participate in the League
- You expressly agree and promise to accept all of the risks existing in this activity
- You elect to participate in spite of the risks
- No one has coerced or pressured you to participate
- You could choose not to participate but have made an informed decision to do so
3.7 No Liability for Harm
TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE OPERATORS SHALL HAVE NO LIABILITY WHATSOEVER FOR ANY HARM, INJURY, LOSS, DAMAGES, OR DEATH (COLLECTIVELY "HARM") ARISING FROM OR RELATED TO:
- In-person meetings, interactions, or matches between users
- The conduct, actions, omissions, negligence, or intentional misconduct of any user
- Criminal acts committed by users against other users
- Unsafe conditions at meeting locations or tennis facilities
- Any activities occurring outside the Application
- Equipment failure or malfunction
- Weather conditions or environmental factors
- Your own conduct or decision-making
This limitation applies:
- Whether such harm was foreseeable or unforeseeable
- Whether arising from negligence, gross negligence, recklessness, or intentional acts
- Even if the Operators were advised of the possibility of such harm
- Regardless of the legal theory (contract, tort, strict liability, etc.)
4. Accounts and Security
4.1 Account Registration and Accuracy
You agree to provide true, accurate, current, and complete information when registering with the League. You are responsible for maintaining the accuracy of your account information and updating it as necessary.
4.2 Password Security
You are responsible for:
- Maintaining the confidentiality of your account credentials (username and password)
- All activities that occur under your account, whether authorized or unauthorized
- Ensuring your account is not used by minors or unauthorized persons
- Immediately notifying the Application administrators of any unauthorized access or suspected security breach
- Using strong, unique passwords and enabling any available security features
4.3 Account Restrictions
You agree not to:
- Share your account credentials with any other person
- Use another person's account without permission
- Create multiple accounts or fake accounts
- Impersonate any person or entity
- Allow anyone else to access your account
The Operators will not be liable for any loss that you may incur as a result of someone else using your password or account, whether with or without your knowledge. You may be held liable for losses incurred by the Operators or another party due to someone else using your account.
5. User Content
You may submit information through the Application, including match scores, messages, photos, and profile details ("User Content").
5.1 License Grant
You grant the Application a non-exclusive, worldwide, royalty-free, perpetual, irrevocable, transferable, sublicensable license to use, display, store, reproduce, modify, create derivative works from, and process User Content solely for the purposes of:
- Operating and improving the Application
- Providing services to users
- Marketing and promoting the Application
- Complying with legal obligations
- Enforcing these Terms
5.2 Your Representations
You represent and warrant that:
- You have all rights necessary to submit the User Content
- Your User Content does not infringe any third-party intellectual property rights
- Your User Content does not violate any applicable laws
- Your User Content is accurate and not fraudulent or misleading
5.3 Prohibited Content
You agree not to submit User Content that:
- Contains false, misleading, or fraudulent information
- Infringes copyrights, trademarks, or other intellectual property rights
- Contains personal information of others without their consent
- Is threatening, harassing, defamatory, or obscene
- Promotes illegal activity or violence
- Contains malware, viruses, or malicious code
5.4 Photographs and Media Rights
By participating in the League, you hereby grant the Operators and their designees the irrevocable right and permission to:
- Photograph, video record, or otherwise capture your image, voice, name, and likeness
- Use, reproduce, modify, distribute, publish, display, or transmit such photographs, recordings, or media
- Use such media for any purpose, including promotional, marketing, operational, educational, or commercial purposes
- Use such media in any medium or format, now known or later developed
- Use such media without restriction of any kind
You acknowledge and agree that:
- No compensation will be paid to you with respect to such photographs or media
- You waive any right to inspect or approve the finished product or any use thereof
- You waive any moral rights, rights of publicity, or privacy rights you may have
- You release the Operators from any claims related to such use, including but not limited to invasion of privacy, violation of moral rights, defamation, false light, and all other potential legal theories
6. Use of Application Information
6.1 Permitted Uses
Information that you obtain through the Application is solely for use related to participating in the League. You may use contact information and other user data only for the purpose of scheduling and coordinating tennis matches.
6.2 Prohibited Uses of Information
You may not:
- Download, modify, copy, distribute, transmit, display, perform, reproduce, publish, license, create derivative works from, transfer, or sell any information or services obtained from the Application
- Use any information obtained from the League (including other members' contact information) for any purpose unrelated to playing in the League
- Use user information for commercial purposes, marketing, or solicitation
- Share, sell, or transfer user information to third parties
- Scrape, harvest, or collect user data through automated means
- Use information to harass, stalk, or harm other users
7. Privacy and Data
7.1 Data Collection and Use
The Application collects and processes personal data you provide, including:
- Name, email address, phone number
- Location information (ZIP code, city, state)
- Tennis skill level and playing history
- Match results and communications with other users
- Any other information you choose to provide
7.2 Data Sharing
Your profile information (including name, skill level, and contact information) may be visible to other users to facilitate match scheduling. By using the Application, you consent to this disclosure.
7.3 No Guarantee of Security
While reasonable technical and organizational safeguards may be implemented, you acknowledge and agree that the Operators do not guarantee absolute security.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE OPERATORS ARE NOT RESPONSIBLE AND NOT LIABLE FOR:
- Accidental or unauthorized disclosure of personal data
- Data breaches, hacking, or cyberattacks
- Exposure of private information (name, email, phone, address, or other data)
- Misuse of your information by other users or third parties
- Vulnerabilities, bugs, misconfigurations, or security failures
- Actions of malicious third parties or other users
7.4 Your Responsibilities
You are responsible for:
- Deciding what information to share in your profile
- Understanding that information you share may become public
- Taking precautions to protect your own privacy
- Not sharing sensitive information (financial details, social security number, etc.)
- Using caution when giving out personally identifiable information about yourself or others
8. Prohibited Uses
You agree not to misuse the Application. Prohibited activities include:
8.1 Safety Violations
- Using the Application to stalk, harass, threaten, intimidate, or harm any person
- Using the Application to facilitate any illegal activity, crime, or fraudulent scheme
- Engaging in conduct that endangers the safety of others
8.2 Fraud and Misrepresentation
- Providing false information about your identity, age, location, skill level, or intentions
- Using another person's identity, photos, or credentials
- Creating fake profiles or impersonating others
- Engaging in catfishing or other deceptive practices
8.3 Technical Violations
- Attempting to breach, circumvent, or test security measures
- Accessing parts of the Application you're not authorized to access
- Scraping, data mining, or harvesting user information without authorization
- Transmitting viruses, malware, or malicious code
- Interfering with the proper functioning of the Application
- Using bots, automated systems, or scripts without permission
- Damaging, disabling, overburdening, or impairing the Application's servers or networks
- Attempting to gain unauthorized access to any service, accounts, computer systems, or networks
8.4 User Conduct Violations
- Using information obtained from the League for purposes unrelated to playing in the League
- Defaming, abusing, harassing, stalking, threatening, or sending inappropriate or indecent material to other users
- Violating the legal rights (such as rights of privacy and publicity) of other League members
- Infringing intellectual property rights of others
- Posting spam, advertisements, or unauthorized commercial content
- Violating any applicable local, state, federal, or international law
- Violating any provision of these Terms
8.5 Standard of Conduct During Matches
You specifically agree that while participating in League matches or communicating with League participants, you will NOT:
- Threaten to engage in, or engage in, any violent or abusive behavior
- Use illegal drugs
- Consume alcohol or be under the influence of alcohol during matches
- Use disrespectful, profane, or obscene language
- Make obscene gestures
- Communicate in a way intended to incite, provoke, or harass other participants
- Engage in unsportsmanlike conduct
- Violate facility rules or tennis etiquette
8.6 Consequences of Violations
The Operators reserve the right to, without prior notice:
- Suspend or terminate your account immediately
- Remove any User Content that violates these Terms
- Report suspected criminal activity to law enforcement
- Cooperate fully with legal investigations and subpoenas
- Ban your IP address or device from accessing the Application
- Take legal action to enforce these Terms or recover damages
Termination of your account does not limit any other rights or remedies available to the Operators.
9. Disclaimers
READ THIS SECTION CAREFULLY. IT LIMITS THE OPERATORS' LIABILITY.
9.1 "AS IS" Provision
THE APPLICATION IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY.
9.2 No Warranties
TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE OPERATORS DISCLAIM ALL WARRANTIES, INCLUDING:
- WARRANTIES OF MERCHANTABILITY
- WARRANTIES OF FITNESS FOR A PARTICULAR PURPOSE
- WARRANTIES OF NON-INFRINGEMENT
- WARRANTIES OF TITLE
- WARRANTIES ARISING FROM COURSE OF DEALING OR USAGE OF TRADE
- WARRANTIES THAT THE APPLICATION WILL BE UNINTERRUPTED, SECURE, OR ERROR-FREE
- WARRANTIES REGARDING THE ACCURACY, RELIABILITY, OR COMPLETENESS OF CONTENT
- WARRANTIES REGARDING THE CONDUCT OR SAFETY OF OTHER USERS
9.3 No Guarantee of Safety
THE OPERATORS DO NOT WARRANT OR GUARANTEE:
- That the Application is safe or secure
- That other users are trustworthy, honest, or safe
- That your personal information will remain private
- That you will not experience harm from using the Application
- That matches will proceed safely or without incident
- That the Application will meet your requirements or expectations
- Anything about the participants in the League
- Your safety or health by playing in the League
9.4 Use at Your Own Risk
You use the Application entirely at your own risk. The Operators make no representations about the suitability, safety, or legality of the Application for any purpose.
10. Limitation of Liability
READ THIS SECTION CAREFULLY. IT SIGNIFICANTLY LIMITS THE OPERATORS' LIABILITY TO YOU.
10.1 Exclusion of Damages - Website and Data
THE OPERATORS SHALL NOT BE LIABLE FOR ANY DIRECT, INDIRECT, PUNITIVE, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR OTHER DAMAGES RELATED TO:
- The use or loss of data arising out of or in any way connected with the use or performance of the Application website
- The personal information you provide to the League
- Accidental or unauthorized disclosure of personal data
- Data breaches or security incidents
10.2 Exclusion of Damages - Participation and Personal Harm
TO THE MAXIMUM EXTENT PERMITTED BY LAW, IN NO EVENT SHALL THE OPERATORS BE LIABLE FOR ANY DAMAGES WHATSOEVER, INCLUDING BUT NOT LIMITED TO:
Personal Harm:
- Personal injury, bodily harm, assault, or battery
- Sexual assault or misconduct
- Emotional distress, psychological trauma, or mental anguish
- Wrongful death or loss of consortium
Property and Financial:
- Property damage, theft, or loss
- Loss of data, files, or content
- Loss of profits, revenue, or business opportunities
- Economic losses or financial damages
Other:
- Harassment, stalking, or threatening behavior by other users
- Criminal acts committed by users against other users
- Damages arising from user conduct, whether negligent or intentional
- Damages from data breaches, privacy violations, or unauthorized access
- Indirect, incidental, special, consequential, exemplary, or punitive damages
- Any damages arising from your use of the Application or participation in leagues
10.3 Scope of Limitation
This limitation of liability applies:
- Even if the Operators were advised of the possibility of such damages
- Even if a remedy fails of its essential purpose
- Regardless of the legal theory (contract, tort, negligence, strict liability, etc.)
- Whether damages arise from the Operators' negligence or the conduct of third parties
- To all claims, whether based on warranty, contract, tort, or any other legal theory
- Even if the liability arises out of the negligence or carelessness of the Operators
10.4 Maximum Liability Cap
IN JURISDICTIONS THAT DO NOT ALLOW THE EXCLUSION OR LIMITATION OF LIABILITY FOR CERTAIN DAMAGES:
The Operators' total aggregate liability to you for all claims arising from or related to your use of the Application or these Terms shall not exceed the greater of:
- One Hundred U.S. Dollars ($100.00), or
- The amount you paid (if any) to the Operators for using the Application in the twelve (12) months immediately preceding the claim
10.5 Multiple Claims
The existence of multiple claims or claimants will not expand this limitation. This liability cap applies to all claims in the aggregate.
11. Indemnification
11.1 Your Indemnification Obligations
You agree to indemnify, defend, and hold harmless the Operators, their affiliates, subsidiaries, officers, directors, employees, shareholders, members, agents, contractors, and representatives (collectively, the "Indemnified Parties") from and against any and all:
- Claims, demands, and causes of action
- Liabilities, damages, and losses
- Costs and expenses (including reasonable attorneys' fees and court costs)
Arising from or related to:
Your Conduct:
- Your use or misuse of the Application
- Your violation of these Terms
- Your violation of any applicable law or regulation
- Your in-person interactions, meetings, or matches with other users
- Your negligent, reckless, or intentional misconduct
- Any injury, harm, or damages caused to others by your conduct
- Your infringement of any rights of another person or entity
Your Content:
- Your User Content or other information you submit
- Your infringement of intellectual property rights or other rights of third parties
- False or misleading information you provide
Third-Party Claims:
- Any claims by other users arising from your interactions with them
- Any claims by third parties related to your use of the Application
- Any loss, liability, damage, or cost the Operators may incur due to your participation in the League
11.2 Defense and Settlement
You agree to:
- Cooperate fully in the defense of any such claims
- Not settle any claim without the prior written consent of the Operators
- Reimburse the Indemnified Parties for all costs and expenses incurred in defending claims
This indemnification obligation survives termination of your account or these Terms.
12. Release and Waiver of Claims
READ THIS SECTION CAREFULLY. YOU ARE GIVING UP SUBSTANTIAL LEGAL RIGHTS.
12.1 Covenant Not to Sue
You hereby covenant and agree that you shall NEVER institute, prosecute, or in any way aid in instituting or prosecuting any claim, demand, action, suit, or cause of action at law or equity against the Operators, their officers, directors, employees, subsidiaries, affiliates, shareholders, members, agents, or representatives for any reason whatsoever arising from or related to:
- Your participation in the League
- Your use of the Application
- Your in-person meetings or matches with other users
- Any present or future accidents or injuries occurring to you as a result of your participation in the League
12.2 General Release and Waiver
TO THE FULLEST EXTENT PERMITTED BY LAW, YOU HEREBY EXPRESSLY RELEASE, WAIVE, DISCHARGE, AND COVENANT NOT TO SUE the Operators, their affiliates, officers, directors, employees, subsidiaries, affiliates, shareholders, members, agents, and representatives (collectively, the "Released Parties") from any and all claims, demands, causes of action, damages, losses, liabilities, and expenses of any kind or nature whatsoever, whether known or unknown, suspected or unsuspected, disclosed or undisclosed, arising from or relating to:
- Your participation in tennis leagues organized or facilitated through the Application
- Your in-person meetings, interactions, or matches with other users
- The conduct, actions, omissions, negligence, gross negligence, or intentional misconduct of any other user
- Any injury, harm, damages, or losses (including death) occurring during or related to matches
- The condition or safety of tennis facilities or meeting locations
- Any criminal activity by other users
- Any disputes, conflicts, or incidents with other users
- Death, personal injury, or property damage of any kind or nature whatsoever
THIS RELEASE AND WAIVER EXTENDS TO ALL CLAIMS OF EVERY KIND OR NATURE WHATSOEVER, FORESEEN OR UNFORESEEN, KNOWN OR UNKNOWN, SUSPECTED OR UNSUSPECTED.
12.3 Release Includes Negligence
YOU EXPRESSLY ACKNOWLEDGE AND AGREE THAT THIS RELEASE AND WAIVER APPLIES EVEN IF THE LIABILITY ARISES OUT OF THE NEGLIGENCE OR CARELESSNESS OF THE RELEASED PARTIES.
This release includes, without limitation, claims arising from:
- The negligence of the Released Parties
- The gross negligence of the Released Parties (to the extent permitted by law)
- The negligence or misconduct of other users or third parties
12.4 Knowing and Voluntary Waiver
YOU ACKNOWLEDGE AND AGREE THAT:
- You have read and understand this release and waiver
- This release includes claims based on the negligence, gross negligence, recklessness, or intentional acts of other users or third parties
- This release includes both known and unknown claims
- You are voluntarily giving up substantial legal rights by agreeing to this release
- You have had the opportunity to consult with an attorney regarding this release
- This is an acceptable risk to you given the benefits of participating in the League
12.5 Waiver of Unknown Claims
You expressly waive any rights you may have under laws that limit releases to known claims, including but not limited to California Civil Code Section 1542, which states:
"A general release does not extend to claims that the creditor or releasing party does not know or suspect to exist in his or her favor at the time of executing the release and that, if known by him or her, would have materially affected his or her settlement with the debtor or released party."
YOU UNDERSTAND AND ACKNOWLEDGE THAT YOU MAY LATER DISCOVER CLAIMS OR FACTS IN ADDITION TO OR DIFFERENT FROM THOSE YOU NOW KNOW OR BELIEVE TO EXIST, BUT YOU HEREBY WAIVE ANY CLAIMS BASED ON DIFFERENT OR ADDITIONAL CLAIMS OR FACTS.
12.6 Jurisdictional Limitations
Some jurisdictions do not allow certain waivers or releases. If any provision of this release is unenforceable in your jurisdiction, it shall be enforced to the maximum extent permitted by law, and the remaining provisions shall remain in full force and effect.
13. Dispute Resolution and Arbitration
13.1 Informal Resolution
Before filing any legal claim, you agree to first contact the Operators at mytennisleaguepa@gmail.com and attempt to resolve the dispute informally for at least thirty (30) days.
13.2 Binding Arbitration
YOU AGREE TO SUBMIT ANY DISPUTE ARISING FROM OR RELATED TO THESE TERMS OR YOUR USE OF THE APPLICATION TO BINDING ARBITRATION.
Any disputes will be resolved through binding arbitration in accordance with the rules of a mutually agreed-upon arbitration provider. The arbitration shall take place in Pennsylvania with one arbitrator. Any court of competent jurisdiction may enter judgment on the arbitration award.
13.3 Waiver of Right to Jury Trial
BY AGREEING TO ARBITRATION, YOU WAIVE ANY RIGHT TO:
- Pursue claims in court
- Have a trial with a jury
- Participate in class action lawsuits
- Engage in pre-trial discovery except as provided in arbitration rules
13.4 Class Action Waiver
YOU AND THE OPERATORS AGREE THAT EACH MAY BRING CLAIMS AGAINST THE OTHER ONLY IN YOUR OR ITS INDIVIDUAL CAPACITY, AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS, CONSOLIDATED, OR REPRESENTATIVE PROCEEDING.
Unless both you and the Operators agree otherwise in writing:
- The arbitrator may not consolidate more than one person's claims
- The arbitrator may not otherwise preside over any form of representative or class proceeding
- The arbitrator may only award relief (including monetary, injunctive, and declaratory relief) in favor of the individual party seeking relief
- The arbitrator's award shall only resolve the claims of the individual party
13.5 Exceptions to Arbitration
Notwithstanding the above, either party may:
- Seek injunctive or other equitable relief in court to prevent infringement of intellectual property rights
- Bring claims in small claims court if they qualify under that court's jurisdictional limits
14. Changes to the Terms
14.1 Right to Modify
The Operators reserve the right to update, modify, or replace these Terms at any time, at their sole discretion. Material changes will be posted on this page with a revised "Last updated" date.
14.2 Notice of Changes
For significant changes that materially affect your rights or obligations, the Operators may provide additional notice by:
- Displaying a prominent notice on the Application
- Sending an email to the address associated with your account
- Requiring you to accept the new Terms before continuing to use the Application
14.3 Acceptance of Changes
Your continued use of the Application after changes become effective constitutes your acceptance of the updated Terms. If you do not agree with the modified Terms, you must stop using the Application and may delete your account.
15. Governing Law and Jurisdiction
15.1 Governing Law
These Terms are governed by and construed in accordance with the laws of Pennsylvania, without regard to its conflict of laws principles.
15.2 Jurisdiction and Venue
Subject to the arbitration provisions in Section 13, you agree to the exclusive jurisdiction and venue of the state and federal courts located in Pennsylvania for any disputes arising from or relating to these Terms or your use of the Application.
15.3 Waiver of Jury Trial
TO THE MAXIMUM EXTENT PERMITTED BY LAW, YOU AND THE OPERATORS WAIVE ANY RIGHT TO A JURY TRIAL in any litigation arising from or relating to these Terms or your use of the Application.
16. Participation by Minors
The Application is intended solely for users 18 years of age or older. By using the Application, you represent and warrant that you are at least 18 years old. Minors under 18 are strictly prohibited from using the Application or participating in leagues. The Operators reserve the right to terminate accounts of users under 18 immediately upon discovery, without notice or refund.
17. Intellectual Property
The Application, including its design, layout, look, appearance, graphics, software, and all content (excluding User Content), is owned by or licensed to the Operators and is protected by copyright, trademark, patent, and other intellectual property laws.
Subject to your compliance with these Terms, the Operators grant you a limited, non-exclusive, non-transferable, revocable license to access and use the Application for its intended purpose.
You may not:
- Copy, modify, distribute, sell, or lease any part of the Application
- Reverse engineer, decompile, or attempt to extract source code
- Remove or alter any copyright, trademark, or proprietary notices
- Use the Application's name, logo, or branding without permission
18. Miscellaneous
18.1 Entire Agreement
These Terms, together with any privacy policy or other policies incorporated by reference, constitute the entire agreement between you and the Operators regarding your use of the Application and supersede all prior agreements and understandings, whether oral or written. If there is any conflict between these Terms and any other agreement, these Terms shall govern.
18.2 Severability
If any provision of these Terms is found to be unenforceable or invalid by a court of competent jurisdiction, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.
18.3 Waiver
The failure of the Operators to enforce any right or provision of these Terms shall not constitute a waiver of such right or provision. Any waiver must be in writing and signed by an authorized representative of the Operators.

BY ACCESSING OR USING THE APPLICATION, YOU ACKNOWLEDGE AND AGREE THAT:
- You have read, understood, and agree to be bound by these Terms & Conditions of Use in their entirety
- You understand that you are waiving substantial legal rights, including the right to sue or recover damages for injuries, harm, or death
- You are voluntarily assuming all risks associated with using the Application and meeting with other users
- You understand the disclaimers, waivers, releases, and limitations of liability in these Terms
- You agree to binding arbitration and waive your right to a jury trial
- You have had the opportunity to consult with an attorney regarding these Terms
- You are entering into a legally binding agreement
I UNDERSTAND AND AGREE TO ALL OF THE ABOVE PROVISIONS OF THE TERMS OF USE. I FURTHER UNDERSTAND THAT THE WAIVER, RELEASE, AND OTHER LIABILITY DISCLAIMER PROVISIONS AS WELL AS THE AGREEMENT TO ARBITRATE LIMIT MY ABILITY TO PURSUE CLAIMS AND SEEK DAMAGES AND THAT IS ACCEPTABLE TO ME.
